GoPowerEV, Inc. ("GoPowerEV", "we", "us", and "our") is committed to respecting the privacy of the Personal Information we process. Please read this Privacy Policy ("Privacy Policy") carefully to understand how we collect, use, and process Personal Information.

By visiting, accessing, or using our Services you acknowledge and agree that you have received and read this Privacy Policy. We may update this Privacy Policy from time to time as described in the "Changes to this Privacy Policy" section below. 1. Scope

This Privacy Policy applies to Personal Information that GoPowerEV collects, uses, shares, and otherwise processes when you:

  • Access or use our website available at GoPowerEV.com or any other website operated or made available by GoPowerEV where this Privacy Policy is posted (collectively, the "Site");
  • Access or use GoPowerEV's mobile app ("App");
  • Access or use charging services through a GoPowerEV charging outlet ("Charging Services");
  • Access or use GoPowerEV's property manager application or web portal;
  • Access or use GoPowerEV's installer application for electric contractors;
  • Access or use any tools or documentation we make available through the Services or otherwise;
  • Communicate with us through any written, electronic, or oral communications, including by email, phone, or text message; or
  • Access or use any other technology, platform, dashboard, software, feature, or content owned or operated by GoPowerEV.

For the purposes of this Privacy Policy, we refer to our Site, App, Charging Services, web portal(s), and any other service we provide that is covered by this Privacy Policy as the "Services."

2. What Personal Information We Collect and How

As used in this Privacy Policy, "Personal Information" means any information that identifies or could be used to identify an individual person, which may include name, email address, and phone number. It also includes other non-public information that we associate with such identifying information. Personal Information does not include aggregated or anonymized information. We collect information, including Personal Information, directly from you and indirectly, as described below.

3. Information You Provide to Us

We collect information that you provide directly to us when you access or use the Services or when you interact with us, in the following ways:

  • Account and profile information. For Customers, we collect information to set up your account including name, user ID, password, email address, postal code, county, and information about your vehicle (e.g., VIN, make, model, year). For Property Managers, we collect company and/or property name, business contact information, and professional details such as role and title, as well as information about the property. For Installers, we collect company name, business contact information, and professional details.
  • Charging data. When Customers use the Charging Services, we collect information such as charging session date, start and end time, duration, energy dispensed, charging outlet information, total fees, power cycle patterns, current, and voltage. Charging outlets are equipped with cameras for security reasons and sessions may be video recorded.
  • Requests and questionnaires. If you contact us, we may collect your name, email, phone number, and any other information you include, as well as information from surveys or questionnaires.
  • Technical support requests and feedback. We collect information to process and respond to your submission, such as your name, contact information, the reason for contacting us, and any other information you provide.
  • Marketing and communications information. If you sign up to receive newsletters and marketing communications, we collect your name and contact information such as email address and/or phone number.

Some Personal Information is necessary so that we can provide you with the Services you have requested. Failure to provide this information may prevent us from providing you access to our Services.

3.1 Information We Collect Automatically

When you access or use our Services, we or our third-party service providers automatically collect information about the device you use and your activity when you use the Services:

  • Device and usage information. This may include your IP address, browser type, unique device identifiers, approximate location, hardware information, log information and crash data, as well as usage information such as features used, clickstream data, access dates and times, and how you interact with the Site.
  • Geolocation information. If you install our App, we may ask to access your device's geolocation data to provide and improve the Service. You can disable location functions on your device, though some parts of the Service may then be unavailable.
  • Cookies and other tracking technologies. We and/or our service providers may collect information using cookies or similar technologies such as pixels, embedded scripts and e-tags. See our Cookie Policy below.

3.2 Information Collected from Third Parties

Depending on the Services you use, we process Personal Information we receive from third parties, which consists of:

  • Property Managers. If you are a Customer, we may receive information about you from your Property Manager, such as your name and contact information.
  • GoPowerEV's Service Providers. We receive information from service providers and agents who perform business services for us, such as site information and transactional data.
  • Analytics and Marketing Providers. We may receive information from entities who perform data analytics and marketing functions for GoPowerEV.

4. How We Use Personal Information

We use the information we collect to:

  • Provide and operate the GoPowerEV Services;
  • Create your account, including to validate new Customer accounts at a specified property;
  • Process and reload payments, manage subscriptions, and facilitate billing;
  • Manage and maintain your account;
  • Update, improve and enhance the Services, and develop new features and products;
  • Provide technical support, secure and protect the Services, and detect and prevent fraud, abuse or security risks;
  • Conduct analytics related to the Services;
  • Market our Services and third-party products and services that may be of interest to you;
  • Respond to your inquiries and requests and provide assistance;
  • Provide updates and send newsletters;
  • Enforce our Terms and Conditions, resolve disputes, and protect our business interests and the rights of third parties;
  • Comply with legal and contractual obligations; and
  • Keep you updated about changes to our policies.

We may combine information we collect from you with other information, including information obtained from third parties.

5. How We Share Personal Information

We share Personal Information with the following types of third parties:

  • Property Managers. If you are a Customer, we may share account and activity information with your Property Manager to confirm eligibility and fees, for example, reports on usage and kilowatt hours charged.
  • Property Manager / Installer Account Administrators. If you use the Services as part of an organization account, we share account and usage information with your manager, supervisor, or account administrator.
  • Service Providers. We share Personal Information with vendors, installers, consultants, agents, contractors and service providers who help us maintain and support our infrastructure and provide our Services.
  • Business Transfers. We may share Personal Information in connection with a merger, acquisition, financing, reorganization, or sale or transfer of some or all of our assets.
  • Compliance and Regulatory Purposes. We may share information to comply with law, protect the safety or security of the Services or any person, investigate illegal activity, prevent fraud or abuse, or protect our rights or property.

Non-public information about our users will not be released to law enforcement except in response to an appropriate legal process, unless we have a good faith belief that there is an exigent emergency. There may also be situations where you are asked to consent to share Personal Information with third parties for additional reasons not included in this Privacy Policy.

7. Payment Processor

GoPowerEV does not directly collect or store Customer payment information. We use third-party, PCI-compliant payment processors, such as Stripe, to collect and process payments on our behalf. Our payment processors may provide us with limited information such as the last four digits of your payment card number, expiration date, and transaction confirmations. Information collected by these third-party payment processors is governed by their privacy policies, which you should review before submitting any information.

8. How We Protect Personal Information

We take our responsibility to protect the security and privacy of Personal Information seriously and have implemented what we believe to be reasonable and appropriate security measures designed to prevent Personal Information from being lost, used, accessed, altered, or disclosed in an unauthorized or unlawful way.

However, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee that Personal Information is completely secure. By using the Services, you understand and assume the risks associated with your activities on the Internet. 9. Children's Privacy

Our Services are not intended for use by minors under the age of 16, and we do not knowingly collect Personal Information directly from minors under the age of 16. If you learn that a child under the age of 16 has provided us with Personal Information, please contact us.

10. Third-Party Links

On the Site or elsewhere in the Services, we may provide links to other websites or resources ("External Websites") for informational purposes only. These links are not endorsements. By clicking on links to External Websites, their operators may collect your Personal Information. We are not responsible for the content or data collection practices of External Websites, and your use of them is subject to their respective terms and privacy policies.

11. How Long We Retain Your Personal Information

We retain Personal Information for the purposes stated in this Privacy Policy and as required under applicable law. To determine how long we keep Personal Information, we consider its amount, nature and sensitivity, the reasons we collect and process it, and applicable legal requirements.

If you use the Services as part of a Property Manager account (e.g., your employer), we retain your Personal Information as long as required by the administrator of your account.

12. Do Not Track Preferences

The Services do not monitor for or behave differently if your browser or device transmits a "do-not-track" or similar message.

13. Your California Privacy Rights

If you are a California resident, you may ask us to refrain from sharing your Personal Information with third parties for their direct marketing purposes. We do not share Personal Information with third parties for their own marketing purposes.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Effective Date" at the top and post a link to the updated Privacy Policy on our Site. Changes are effective when posted on this page. If we make material changes, we will provide notice as required under applicable law. Please review this Privacy Policy periodically.

16. GoPowerEV Cookie Policy

This "Cookie Policy" describes the different types of cookies we use in connection with our Services and how to manage them. Terms that are capitalized but not defined here have the meanings given to them in our Privacy Policy above.

16.1 What Are Cookies?

Cookies are small data files placed on your computer or mobile device by us or by third parties when you visit a website or other online service. GoPowerEV uses cookies to provide content or features, help us remember you and your preferences, and improve your experience. In addition to cookies, we use similar technologies such as pixel tags (also called web beacons), which are tiny graphics with a unique identifier that gather information about your interaction with a website or email.

  • Persistent cookies stay in your browser and are read by us when you return, helping us recognize you as an existing user.
